These Terms & Conditions ("Terms") govern your access to and use of the GimBooks application, website and related services (collectively, the "Service") operated by Gim Info Solutions Pvt. Ltd. ("GimBooks", "we", "us" or "our"). By creating an account, subscribing to a plan or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
General Policies
The Service is provided on a subscription basis for use in your lawful business activities. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. We may update, modify or discontinue features of the Service from time to time to improve performance, security and compliance, and we will make reasonable efforts to notify you of material changes.
Definition of an Incident
An "incident" is a single, clearly defined support request relating to one issue, question or error encountered while using the Service. Each incident is logged with a unique reference and is considered closed once a resolution, workaround or final response has been provided. A request that involves multiple unrelated issues may be treated as separate incidents at our discretion.
Support Response Time
We aim to acknowledge support requests submitted through our official channels within one business day. Resolution times vary depending on the complexity and severity of the incident. While we make every reasonable effort to respond promptly, response and resolution times are targets and not guarantees.
Support Limitations
Support is limited to the standard functionality of the Service and does not cover issues arising from third-party software, hardware faults, network problems, unsupported device configurations or unauthorized modifications. We do not provide professional accounting, tax or legal advice, and any guidance offered by support staff is for general informational purposes only.
Product Upgrade Limitations
From time to time we release upgrades, new features and improvements. Some upgrades may be included in your existing plan, while others may be offered as paid add-ons or higher-tier plans. We reserve the right to determine which features are available under each plan and to change plan inclusions with reasonable notice.
Data Recovery Service
Where technically feasible, we may assist with recovering data that has been lost due to a Service-side issue. Data recovery for losses caused by user error, device failure or actions taken outside the Service may be offered as a chargeable service and is provided on a best-effort basis without any guarantee of full recovery.
Password Removal Service
For security reasons, password or access-credential removal is performed only after we have verified that you are the rightful account holder. This may require documentary proof of ownership. Such requests may be subject to a service fee and reasonable processing time.
Monthly Payment Plan
Subscriptions are offered on a twelve (12) month commitment. Where a monthly payment option is made available, you authorize us to charge the applicable amount on each billing date for the full duration of the commitment period. Selecting a monthly payment schedule does not reduce the underlying twelve-month commitment.
Renewal Policy
Plans renew automatically at the end of each subscription term unless you cancel at least five (5) days prior to the renewal date. If a payment is missed, a grace period of fifteen (15) days is provided to settle the outstanding amount before the account is suspended. Following suspension, your data is retained for sixty (60) days, after which it may be permanently deleted.
Limitation of Liability
To the maximum extent permitted by law, GimBooks shall not be liable for any indirect, incidental, special or consequential damages, or for any loss of profits, data or goodwill arising from your use of the Service. In all cases, our total aggregate liability shall not exceed the total fees actually paid by you to GimBooks during the twelve (12) months preceding the event giving rise to the claim.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Chhattisgarh, India, without regard to its conflict-of-law principles. Subject to any dispute resolution process set out herein, the courts located in Chhattisgarh, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms.
Privacy Statement
Your privacy is important to us. Our collection, use and protection of your information is described in our Privacy Policy, which forms part of these Terms. By using the Service, you also consent to the practices described in the Privacy Policy.
Refund Policy
Subscriptions are eligible for a refund only within three (3) days of purchase and only where the plan has not been used. If the plan remains unused, you may request a full refund within this three-day window through our official support channels. Once the plan has been used, or after the three-day window has elapsed, fees paid are non-refundable except where required by applicable law.
